1. Contractual Information

1.1 Information Relating to the Professional: These General Terms and Conditions govern the purchase of goods and/or services by consumers made at a distance, via computer network, on the website https://shop.qcterme.com, of QC Terme S.r.l., with registered office in 20139, Milan (MI), Piazza Adriano Olivetti 3, Tax Code and Register of Companies 00828430157, VAT No. 10541980966, R.E.A of Milan No. 508289, (hereinafter "QC Terme").

1. 2 Information regarding contracts concluded by the consumer: All information prescribed by the applicable legislation, or by the nature of the contract, relating to each individual contract concluded through the website of QC Terme srl, including for the sole purpose of example and not exhaustive, the main characteristics of the goods or services, their price (including taxes), additional shipping, delivery or postal charges and any other costs, the method of payment the timing of delivery of the goods or execution of the order, the duration of the contract, if any, the minimum duration of the consumer's obligations, will be specified in the order form to be accepted and sent electronically by the consumer, with express acknowledgment by the consumer that sending the order entails an obligation to pay. If, due to the nature of the contract or the good or service ordered, one or more of the above information should not be available at the time of submission of the order, the consumer will be promptly informed; if the price could not be determined at the time of the order, the consumer will nevertheless be notified of the manner in which the price will be calculated; if other expenses or costs pertaining to the contract or its performance could not be determined at the time of the order, the consumer will be informed of this circumstance and of the possibility that such expenses and costs will be subsequently charged to him or her.


1.3 Information relating to consumer rights: All information relating to the rights granted to the consumer by the applicable legislation, such as for example, for the sole purpose of example and not exhaustive, information relating to the right of withdrawal (when applicable), the guarantee of conformity of goods, any after-sales service, the processing of personal data, the methods by which to make purchases on the website of the professional, will be specified in these General Conditions, or in the documents referred to therein and which are accessible from these General Conditions via hypertext links.

 

1.4 Information on applicable legislation: All contracts concluded by consumers through the website of QC Terme srl shall be fully governed by the following provisions and by the documents, instructions and information referred to therein, in accordance with the provisions of Legislative Decree No. 206/2005 (containing the Consumer Code), Legislative Decree No. 70/2003 (containing rules on electronic commerce), Legislative Decree No. 29/2010 (containing rules on services in the internal market), and Legislative Decree No. 196/2003 (containing the Privacy Code). Anything not expressly governed by these General Conditions and the above legislation shall be governed by the Civil Code.


2. Buyer's Commitments

These General Terms and Conditions, available online at https://shop.qcterme.com, are made available to consumers who may print them out or save them in digital format on their computer memory. Consumers should review these General Terms and Conditions carefully before proceeding to purchase products and/or services on the QC Terme website. In any case, before completing the electronic procedure of placing the purchase order, these General Conditions are shown to the consumer, and the consumer must proceed to their full and unconditional acceptance by placing a flag in the dedicated box in order to proceed with the purchase.

3. Stipulation of the contract

The order sent through the QC Terme website by the consumer is a contractual offer that QC Terme S.r.l. reserves the right to accept.
It is necessary to check whether the amount indicated for the services and/or goods chosen is correct before sending the order. When sending the order through the computer interface of the site, the consumer will be required to press a virtual button that will attest that the consumer has acknowledged that the sending of the order and its subsequent acceptance by QC Terme will involve the payment of a price.
The contract is finalized with the forwarding, through the site, of an e-mail summarizing the services and/or products ordered and the other essential elements of the contract to the e-mail address indicated by the consumer when sending the order, this e-mail communication will perform the function of acceptance of the order sent by the consumer.

4. Conditions and terms of payment of the Price

The payment is made immediately after the order of the good and/or service and before its delivery, according to the modalities chosen by the Buyer during the telematic procedure of purchase, modalities that are specified prominently on the website of QC Terme in the initial screen of the order procedure.
The prices indicated include VAT when due.

5. Withdrawal and refund

Pursuant to Article 52 of the Consumer Code, the Buyer has a period of 14 days, starting from the date of stipulation or delivery (in case of purchase of goods), to withdraw from the contract. 6. Provision - Use - Validity of Services

Virtual Shipping - For services for which the customer will have chosen the virtual shipping option, a voucher will be sent to the email address(es) indicated by the consumer.

Physical Delivery - For vouchers for which the Consumer will have chosen the physical delivery option, they will be sent by mail or courier to the address(es) indicated by the Consumer. In this case, shipping charges however indicated at the time of purchase or choice of shipping or delivery method may apply.

Use and validity of vouchers - To take advantage of the services of a voucher it must be delivered by the user to the reception of the chosen facility at the time of the use of the services contained therein.
The provision of the service will take place only after presentation of the voucher and subject to availability. It is therefore necessary to follow the rules on reservations where applicable.
Unless otherwise explicitly imprinted or written on the vouchers, whether virtual or ordinary, they are valid for 24 months from the date of issuance, after which time the right to use the services permanently lapses. No refund is due for unused services. In case of several services included in the same voucher these must be used on the same day.

In case of loss, theft, damage, non-use or expiration of the voucher the consumer will not be entitled to any refund.


7. Information and Complaints, Guarantee of Compliance, Privacy and Purchasing Guide

QC Terme may be contacted for any clarifications or complaints at the addresses and contact details specified in Section 1.1 of these Terms and Conditions.
Goods sold through the QC Terme website are covered by a conformity warranty in accordance with the provisions of Articles 128 et seq. of the Consumer Code (Legislative Decree 206/2005).

8. Applicable Law

This contract will be governed by Italian law.
